Acceptance of Terms and Conditions

All agreements relating to the teaching of the classes by FSSK to the students are subject to these Terms and does not include any other Terms and/or Conditions. There shall be no variation, altering of FSSK Terms and as a result making this a be binding contract unless agreed in writing by FSSK and the Parent. All Terms shall be deemed to have been accepted by the Parent upon payment of the Fee by or on behalf of the Parent. A Payment for the Student shall be deemed to have been made on behalf of the Parent.

Fee and Payment

• We accept ALL forms of Payment Visa Debit, Visa Credit, Mastercard Debit and Mastercard Debit.
• Parent(s) are required to pay all fees to FSSK prior to the beginning of the participant(s) attending their first day of class.
• Fees are non-refundable under any circumstances, except a medical emergency or with a prior written agreement between FSSK and parent.
• If classes are cancelled as a result of an “Act of God” (e.g., severe unanticipated natural event for which no human is responsible for example, extreme weather conditions, earthquakes, etc.), strikes, terrorist activity, or where local authorities/public guidance advise that classes should be temporarily suspended for health or other reasons, pending classes will be made up at a later date determined by FSSK.

Cancellation

• FSSK may cancel this contract at any time before the student commences the class for any reason whatsoever. FSSK shall not be liable for any loss or damage whatsoever arising from such cancellation.
• In the event of cancellation by FSSK prior to the commencement of the class, FSSK will refund any fees for outstanding classes within 30 days.
• The Parent understands that classes are to be used consecutively. Classes are not allowed to be rolled over to an upcoming enrollment period due to non-attendance for any reason, unless agreed in writing with FSSK.

Parent’s Responsibility

• The information provided during the Registration of a Student by the Parent is accurate in all respects and the Parent will notify FSSK of any change in such information immediately.
• Please remain at home if the Parent and or the student are suffering from any contagious illness, disease, injury or anything similar thereto.
• The Parent acknowledges and agrees that the student shall be deemed to be under the direction of FSSK throughout the class, however Parents shall be responsible for the welfare whilst the student is on the Premises i.e., bathroom breaks, water breaks etc.
• The Parent shall indemnify and keep indemnified FSSK against all loss (including loss of profit), liability, costs and expenses which FSSK shall incur directly or indirectly as a consequence of any action or inaction of the Parent or the Student
• I further agree to indemnify and keep indemnified FSSK and hold harmless Future Starz, its agents, servants, employees, partners and/or representatives from any and all liability, damage/injury, cost or expense arising out of my child’s participation, of every kind and nature, in FutureStarz events.
• Parent(s) agrees that in the event that you cannot be reached in an emergency, I hereby give permission for care to be administered by a qualified Future Starz staff member, EMT, physician/staff of a hospital, or any other qualified individual to provide any medical treatment deemed necessary for my child.
• Parent(s) will undertake any and or all cost for medical treatment from any injury suffered from any Future Starz event.
• Parents are required to Opt-In or Opt-Out at the time of registration if FutureStarz are allowed to use photographs and/or videos of their child while participating in FutureStarz sponsored and or organized activities.

Discipline

• In the event that FSSK determines the behavior of the student to be unacceptable, FSSK shall be entitled to exclude the student from class or for such period as FSSK shall (in its entire discretion) determine.
• The standard of behavior which is to be regarded as unacceptable at a class or on Premises shall be determined by FSSK.

Exclusion of Liability

• Except in the case of fraud, FSSK, its coaches, servants, employees or agents accept no responsibility under any circumstances for any loss (consequential or otherwise), damage, expense or delay suffered or incurred by the Parent, the Student or any other party arising directly or indirectly or in any way connected with the attendance of the Student at the class (or any part of it) or any other act or omission on the part of FSSK or any of its coaches, employees or agents even if such act or omission is negligent.
• The Parent agrees (for and on behalf of the Parent and the Student) that any claim by the Parent or the Student against FSSK or any coach, employee or agent of FSSK must be brought within 60 days of the event that gave rise to such claim. Any claim made thereafter shall be time-barred.
• The Parent acknowledges, warrants and undertakes (for and on behalf of the Parent and the Student) that the maximum aggregate liability of FSSK to the Parent and/or Student under these terms shall not exceed the Fee.
• All warranties and conditions whether implied by statute or otherwise are excluded from this contract provided that nothing in this contract shall restrict or exclude liability for death or personal injury caused by the negligence of FSSK, its coaches, servants, employees or agents, partners or affects the statutory rights of the Parent or Student.
